The period of adolescence, i.e., the period between childhood and adulthood, may be long or short, depending on social expectations and on society’s definition as to what constitutes maturity and adulthood. In primitive societies adolescence is frequently a relatively short period of time, while in industrial societies with patterns of prolonged education coupled with laws against child labor, the period of adolescence is much longer and may include most of the second decade of one’s life. Furthermore, the length of the adolescent period and the definition of adulthood status may c

hange in a given society as social and economic conditions change. Examples of this type of change are the disappearance of the frontier in the latter part of the nineteenth century in the United States, and more universally, the industrialization of an agricultural society.

In modern society, ceremonies for adolescence have lost their formal recognition and symbolic significance and there no longer is agreement as to what constitutes initiation ceremonies. Social ones have been replaced by a sequence of steps that lead to increased recognition and social status. For example, grade school graduation, high school graduation and college graduation constitute such a sequence, and while each step implies certain behavioral changes and social recognition, the significance of each depends on the socio-economic status and the educational ambition of the i

ndividual. Ceremonies for adolescence have also been replaced by legal definitions of status roles, right, privileges and responsibilities. It is during the nine years from the twelfth birthday to the twenty-first that the protective and restrictive aspects of childhood and minor status are removed and adult privileges and responsibilities are granted. loses childhood privileges without gaining significant adult rights. In country after country, talk of nonsmokers' rights is in the air. This fresh voice is heard from Australia to Sweden. Its force is freeing clean air for nonsmokers -- and tightening the situation for smokers.

While a majority of countries have taken little or no action yet, some 30 nations have introduced legislative steps to control smoking abuse. Many laws have been introduced in other countries to help clear the air for nonsmokers, or to cut cigarette consumption.

In many developing nations, however, cigarette smoking is seen as a sign of economic progress -- and is even encouraged. While it appears that in developed countries the consumption of cigarettes has become stabilized, there are some indications that it is still rising at a steady pace in Latin America.

So far, any cooperation between tobacco interests and governments' campaigns against smoking has been in the area of tobacco advertising.

Over the last 25 years, British society has changed a great deal — or at least many parts
of it have. In some ways, however, very little has changed, particularly where attitudes are concerned. Ideas about social class — whether a person is "working-class" or "middle-class"— are one area in which changes have been extremely slow.

In the past, the working-class tended to be paid less than middle-class people, such as teachers and doctors. As a result of this and also of the fact that workers' jobs were generally much less secure, distinct differences in life-styles and attitudes came into existence. The typical working man would collect his wages on Friday evening and then, it was widely believed, having given his wife her "housekeeping", would go out and squander the rest on beer and betting.

The stereotype of what a middle-class man did with his money was perhaps nearer the troth. He was — and still is — inclined to take a longer-term view. Not only did he regard buying a house as a top priority, but he also considered the education of his children as extremely important. Both of these provided him and his family with security. Only in very few cases did workers have the opportunity (or the education and training) to make such long-term plans.

Nowadays, a great deal has changed. In a large number of cases factory workers earn as much, if not more, than their middle-class supervisors. Social security and laws to improve job-security, combined with a general rise in the standard of living since the mid-fifties of the 20th century, have made it less necessary than before to worry about "tomorrow". Working-class people seem slowly to be losing the feeling of inferiority they had in the past. In fact there has been a growing tendency in the past few years for the middle-classes to feel slightly ashamed of their position.

The changes in both life-styles and attitudes are probably most easily seen amongst younger people. They generally tend to share very similar tastes in music and clothes, they spend their money in having a good time, and save for holidays or longer-term plans when necessary. There seems to be much less difference than in previous generations. Nevertheless, we still have a wide gap between the well-paid (whatever the type of job they may have) and the low-paid. As long as this gap exists, there will always be a possibility that new conflicts and jealousies will emerge, or rather that the old conflicts will re-appear, but between different groups.

Ergo city authority administers environmental, social care, housing and cultural services
to the city of Ergo. The city itself has many social problems and a recent report from the local government auditor criticised the Chief Executive Offi cer (CEO) for not spending enough time and money addressing the pressing housing problems of the city.

Since 1970 the authority has had its own internal Information Technology (IT) department. However, there has been increasing criticism of the cost and performance of this department. The CEO has commented that ‘we seem to expand the department to cope with special demands (such as the millennium bug) but the department never seems to shrink back to its original size when the need has passed’. Some employees are lost through natural wastage, but there have never been any redundancies in IT and the labour laws of the nation, and strong trade unions within the authority, make it diffi cult to make staff redundant.

In the last few years there has been an on-going dispute between managers in the IT department and managers in the fi nance function. The dispute started due to claims about the falsifi cation of expenses but has since escalated into a personal battle between the director of IT and the fi nance director. The CEO has had to intervene personally in this dispute and has spent many hours trying to reconcile the two sides. However, issues still remain and there is still tension between the managers of the two departments.

A recent internal human resources (HR) survey of the IT department found that, despite acknowledging that they received above average pay, employees were not very satisfi ed. The main complaints were about poor management, the ingratitude of user departments, (‘we are always being told that we are overheads, and are not core to the business of the authority’) and the absence of promotion opportunities within the department. The ingratitude of users is despite the IT department running a relatively fl exible approach to fulfi lling users’ needs. There is no cross-charging for IT services provided and changes to user requirements are accommodated right up to the release of the software. The director of IT is also critical of the staffi ng constraints imposed on him. He has recently tried to recruit specialists in web services and ‘cloud computing’ without any success. He also says that ‘there are probably other technologies that I have not even heard of that we should be exploring and exploiting’.

The CEO has been approached by a large established IT service company, ProTech, to form. a new company ProTech-Public that combines the public sector IT expertise of the authority with the commercial and IT knowledge of ProTech. The joint company will be a private limited company, owned 51% by ProTech and 49% by the city authority. All existing employees in the IT department and the IT technology of the city authority will be transferred to ProTech who will then enter into a 10 year outsourcing arrangement with the city authority. The CEO is very keen on the idea and he sees many other authorities following this route.

The only exception to this transfer of resources concerns the business analysts who are currently in the IT department. They will be retained by the authority and located in a new business analysis department reporting directly to the CEO.

The CEO has suggested that the business analysts have the brief to ‘deliver solutions that demonstrably offer benefi ts to the authority and to the people of the city, using information technology where appropriate’. They need to be ‘outward looking and not constrained by current processes and technology’. They will also be responsible for liaising between users and the newly outsourced IT company and, for the fi rst time, defi ning business cases with users.

In principle, the creation of the new company and the outsourcing deal has been agreed. One of the conditions of the contract, inserted by the fi nance director, is that the new company achieves CMMI level 5 within three years. The current IT department has been recently assessed as CMMI level 2. ProTech has recently been assessed at CMMI level 3.

Moral responsibility is all very well, but what about military orders? Is it not the soldi
er's duty to give instant obedience to orders given by his military superiors? And apart from duty, will not the soldier suffer severe punishment, even death, if he refuses to do what he is ordered to? If, then, a soldier is told by his superior to burn this house or to shoot that prisoner, how can he be held criminally accountable on the ground' that the burning or shooting was a violation of the laws of war?

These are some of the questions that are raised by the concept commonly called "superior orders", and its use as a defense in war crimes trials. It is an issue that must be as old as the laws of war themselves, and it emerged in legal guise over three centuries ago when, after the Stuart restoration in 1660, the commander of the guards at the trial and execution of Charles I was put on trial for treason and murder. The officer defended himself on the ground "that all I did was as a soldier, by the command of my superior officer whom I must obey or die," but the court gave him short shrift, saying that "When the command is traitorous, then the obedience to that command is also traitorous①."

Though not precisely articulated, the rule that is necessarily implied by this decision is that it is the soldier's duty to obey lawful orders, but that he may disobey—and indeed must, under some circum stances-unlawful orders. Such has been the law of the United States since the birth of the nation. In 1804, Chief Justice John Marshall declared that superior orders would justify a subordinate's conduct only "if not to perform. a prohibited act," and there are many other early decisions to the same effect.

A strikingly illustrative case occurred in the wake of that conflict which most Englishmen have never heard (although their troops burned the White House) and which we call the War of 1812. Our country was baldly split by that war too and, at a time when the United States Navy was not especially popular in New England, the ship-in-the-line Independence was lying in Boston Harbor. A passer-by directed abusive language at a marine standing guard on the ship, and the marine, Bevans by name, ran his bayonet through the man. Charged with murder, Bevans produced evidence that the marines on the Independence had been ordered to bayonet anyone showing them disrespect. The case was tried before Justice Joseph Story, next to Marshall, the leading judicial figure of those years, who charged that any such order as Bevans had invoked "would be illegal and void," and, if given and put into practice, both the superior and the subordinate would be guilty of murder②. In consequence, Bevans was convicted.

The order allegedly given to Bevans was pretty drastic, and Boston Harbor was not a battlefield; per haps it was not too much to expect the marine to realize that literal compliance might lead to bad trouble. But it is only too easy to conceive of circumstances where the matter might not be at all clear. Does the sub ordinate obey at peril that the order may later be ruled illegal, or is protected unless he has a good reason to doubt its validity?
